We care about your privacy. We process personal data of our customers, clients, suppliers, visitors, contractors, business relations and all other persons who contact us or us our services (hereafter together referred to as: ‘you’).

This privacy statement addresses what information we collect about you (“Privacy Statement”) when you make use of this website or other services. We will explain why we collect this information, what rights you have and where to go for further information.

The Privacy Statement may be changed from time to time. Any amendment shall enter into force after it has been approved and published. This Privacy Statement was published on February 10th 2025.

2. Who are we?

L - founders of loyalty advises on, designs, analyses, executes and evaluates short-term loyalty programs and provides all necessary related (digital) services. To do this we follow information usage practices based on our beliefs: first, that protecting user privacy is essential to the growth and success of online digital services provided by L - founders of loyalty; second, that a personalized digital experience can provide significant benefits to our clients and their customers if done properly. L - founders of loyalty works with all of its clients and suppliers without compromising individual privacy.

We are responsible for the processing of your personal data as described in this Privacy Statement and qualify as ‘data controller’ under applicable data protection laws.
Your data is being processed by or on behalf of L - founders of loyalty Group B.V., registered at the Dutch Chamber of Commerce under number 76145735, and/or any of its affiliated entities worldwide (“L - founders of loyalty”). When we talk about “we”, “us” and “our” we mean all L – founders of loyalty companies in all countries.

However, we do not always act as a data controller. We can also process personal data as data processor on behalf of our clients. This is for instance, the case when you are a participant of a loyalty program. For reasons of completeness, we have also added the information in this Privacy Statement in the cases we act as data processor on behalf of our clients. Specific data protection conditions imposed by the relevant client can apply to the processing of this information. In any event it is recommended to check the privacy statement of the relevant client as well.

3. What categories of personal do we process?

Consumers

As part of our loyalty business,  L - founders of loyalty processes personal information on behalf of our clients in case you participate in one or more of our clients’ loyalty programs. With such participation, we may process the following personal information about you:

  • Personal details: first name and last name
  • Contact details: such as email address and/or telephone number
  • Loyalty card number or other identification numbers.
  • Loyalty program information, including transactional data.
  • Any other personal data provided by you directly, for instance in surveys.
  • Any personal data whose processing is required pursuant to, or necessary with a view to the application of legislation.

L - founders of loyalty may have (partly) received your data from sources other than directly from yourself, i.e. by obtaining information from our clients who we help setting up and/or maintaining any loyalty program, intermediary parties, market research companies and social media companies.

Business partners

L - founders of loyalty collects and processes data relating to persons who (want to) work with us such as clients, suppliers, agencies or other business relations.

L - founders of loyalty may process the following data categories about you:

  • Personal details: first name and last name.
  • Contact details: such as email address and/or telephone number
  • Company and job details.
  • Country
  • Any other personal data provided by you directly.
  • Any personal data whose processing is required pursuant to, or necessary with a view to the application of legislation.

L - founders of loyalty may have (partly) received your data from other sources besides directly from you, i.e. by obtaining information from the local Chamber of Commerce or to do other (legal) checks to prevent corruption, identity theft, financial fraud, money laundering and/or terrorist financing (Know Your Customer procedures).

Website visitors

If you visit our website we process personal information such as:

  • Personal details: first name and last name
  • Contact details: such as email address and/or telephone number
  • Information about your preferences: we process the information that you give us, such as a specific job, or a specific whitepaper.
  • Communication details: if you send us an email or send us a message via social media.
  • Information we collect when you enter our website: if you visit our website, we’ll collect your IP-address, browser, operating system, referral and surf behavior
  • Information regarding social media: depending on your settings in social media, we can receive information from the provider of your social network.

   

Recruitment

As part of our recruitment process,  L - founders of loyalty processes personal information that we receive directly via your application or through recruitment agencies or other sources.
Depending on the precise role or event you are applying for, L - founders of loyalty may process the following personal data:

  • Personal and contact information such as your first name, last name, address, email and phone number;
  • Work related information such as resume, letter of application, certificates and details of education, areas of interest and other information you provide to us in an application and/or the recruitment process;
  • Pre-employment screening information, where applicable and in compliance with applicable law(s);
  • Assessment results, if applicable.

Further our website uses ‘cookies’, which are small text files stored on your device, to help operate the site and collect information about your online activity. More information on the use of cookies can be found in our cookie statement as published on our website.

4. For what purposes do we process your personal data?


L - founders of loyalty processes your personal data for the following purposes:

Consumer information

  • For our loyalty program purposes. For example if you participate in a loyalty program or make use of any of the related (digital) services;
  • Data validation, enhancement, information verification and suppression;
  • To comply with applicable laws and regulations or to respond to a lawful request for information received by us, whether or not a response is required by applicable law;
  • To enforce our terms of use and other agreements or to protect our rights;
  • To protect the safety of members of the public and users of the service;
  • Reporting purposes

Business partners

  • For our loyalty program services
  • To contact clients, suppliers and other business relations;
  • To register visitors of our offices;
  • To communicate with you and send you business related information;
  • To comply with applicable laws and regulations or to respond to a lawful request for information received by us, whether or not a response is required by applicable law;
  • To enforce agreements or to protect our rights;
  • Reporting purposes.

Website

  • To process your contact request, communicate with you and provide you with information in case you reach out to us;
  • To process your registration for Industry insights and creative inspiration. In that case we will send you follow-up emails and newsletters with industry information. . To determine what is relevant to you, we may use automated tools to analyze your personal information. You can opt-out of receiving these marketing updates at any time by using the unsubscribe link in the emails or by contacting us through the contact details below. This processing is based on your consent, which is provided when you request to receive these our newsletter, receive new offers and other business updates;
  • To comply with applicable laws and regulations or to respond to a lawful request for information received by us, whether or not a response is required by applicable law;
  • To enforce agreements or to protect our rights;
  • Reporting purposes.

   

Recruitment information

  • L - founders of loyalty processes your personal data for the following purposes:
  • To support a responsible recruitment and effective process whereby we assess your suitability, skills and qualifications for the relevant position;
  • To comply with applicable laws, regulations and legal processes.

Other

We use automated tools to conduct statistical research on general trends in the use of our services, websites, digital applications, and social media, as well as on the behavior and preferences of consumers, business partners and users.

For conducting our research, we aggregate and analyze various types of data. We may also combine such aggregated data with information we obtain from public sources. Statistical research enables us to develop better services, products and offers.

  • For personalized advertisements: We may participate in Facebook's Custom Audience program or similar programs of other advertisers. In such a case, we share your email address or another way to recognize you. This allows the advertiser to show you a personalized advertisement instead of a general one. You can opt out of this by sending an email from the email address you wish to unsubscribe to privacy@l-founders.com

5. What are the grounds of the processing?

We will process your personal data on one or more of the following legal grounds:

  • Contract. Where the processing of your personal data would be necessary for entering into a contract. This includes any pre-contractual activities.
  • Legitimate interest. Where we have a legitimate interest to conduct business activities,
  • Legal obligation. Where we will process your personal data in order to comply with a legal obligation to which we are subject.
  • Consent. Where needed we will obtain your prior consent. You will always be able to reject consent and there will be no adverse consequences if you do so.

6. How long do we retain your personal data?

Your personal data will not be stored longer than strictly necessary for the purposes of the processing and we will retain such data in accordance with applicable law(s).

7. How do we protect your personal data?

L - founders of loyalty handles your personal data with the greatest care. We have taken appropriate technical and organisational measures to protect your personal data against loss, misuse or accidental, unlawful or unauthorized access.

No transmission of data over the internet is guaranteed to be completely secure. While we strive to protect your data, it may be possible for third parties not under the control of L to unlawfully intercept or access transmissions or private communications. Unauthorized entry or use, hardware or software failure, and other factors may compromise data security. L cannot ensure or warrant the security of information you transmit to us. You acknowledge and assume this risk when communicating with L. L will inform you in case of a data security breach if required by applicable law or otherwise considered feasible in our opinion.

8. With whom can we share your personal data?

If it is necessary in the execution of our services, your personal information may be processed by third parties from time to time.

This may include sharing information (1) to enable third parties to assist or facilitate in the loyalty promotion related services we provide to our clients and its consumers; (2) to comply with applicable laws and regulations; (3) to enforce our terms of use and other agreements; (4) to respond to a lawful request for information received by us; (5) to enable administrative services including, but not limited to, data validation, enhancement, information verification and suppression services; (6) to protect our rights; or (7) for any other purpose for which you provide up front consent.

Third parties include the following: our affiliated entities, recruitment agencies, service providers, business partners, our clients, professional advisors or any government authority.

We will take the necessary steps to ensure that your privacy rights continue to be adequately protected. Where appropriate and/or required, we will put in place written agreements with third parties to further protect the confidentiality and security of your personal data.

9. Transfer of your personal data to other countries

In general, your personal data shall remain in the country where your personal data is collected. We will only transfer your personal data to a third country if it is necessary for the execution of our recruitment services. We will take the appropriate measures to ensure your personal data is protected within the limits set by applicable law.

10. What are your rights with regard to your data?

You have the right and possibility to access, rectify or erase your personal data that is processed by L - founders of loyalty.

In certain circumstances you also have the right to require us to stop processing your personal data even if the retention date has not passed.
